1. Your Agreement
Please carefully read these terms (the "Terms of Use") before using Plushion and the services provided through it by Plushion or third-party operators ("Operators"). By accessing Plushion, you agree to and accept these Terms of Use. The terms "you," "your," and "yours" used herein include (1) any person accessing Plushion and (2) any person purchasing services through you.
Plushion is primarily designed for individuals located in the Hong Kong region. Therefore, we cannot guarantee that Plushion or its information complies with the laws or regulations of other countries/regions or is suitable for use elsewhere. You are fully responsible for any use of Plushion by anyone using your computer, and you must ensure that such individuals comply with these Terms of Use.
The information provided on Plushion is not intended for distribution or use by anyone in any jurisdiction where such distribution or use is prohibited by law or regulation.
2. Changes to the Terms of Use
Plushion may, at the Company’s absolute discretion, modify or update these Terms of Use at any time without prior notice. You should periodically review the latest version of the Terms of Use for applicable conditions. If Plushion modifies or updates these Terms of Use, the changes or amendments will be posted on this webpage, with the date of the last revision indicated at the bottom of this page.
Continued use of Plushion after such changes will signify your agreement to and acceptance of the revised Terms of Use. If you do not agree with any revision to these Terms of Use, you must immediately cease using or accessing Plushion and its Services.
Additionally, when using the Services, you shall be bound by all additional terms related to the Services that may be updated from time to time, as well as the Privacy Policy (hereinafter referred to as the "Privacy Protection Policy") adopted by Plushion from time to time. The Company expressly incorporates all such terms into these Terms of Use by reference.
3. Login and Use of Services
Plushion, the domain name (https://www.plushion.store/), subdomains, technical features, data content, and application services (including but not limited to mobile application services) or related services periodically provided by Plushion are owned and operated by Plushion.
Under these Terms of Use, Plushion may provide Services either on its own behalf or on behalf of other Operators, with such Services described in greater detail on Plushion. The Services you select on Plushion are for your personal use only and may not be provided to any third party for use or profit. The term "Services" includes, but is not limited to, the use of Plushion and any services provided by Plushion, either independently or on behalf of other Operators, on Plushion. Plushion reserves the right to change, suspend, or terminate any Service at any time without prior notice or liability, including any technical features, databases, or content. Plushion also reserves the right to impose restrictions, amend terms, or limit your access to part or all of the Services without prior notice.
Plushion does not guarantee that its Services will operate continuously or be unaffected by external factors. Plushion will not be liable to you at any time for non-operational Services. You are responsible for making all necessary arrangements to access the Services and ensuring that all individuals accessing the Services via a network connection are aware of these Terms of Use and other applicable terms and conditions related to the Services.
When you connect to Plushion, it has the absolute discretion to revoke your right to connect at any time. Plushion may also require you to obtain written permission before linking, accessing, or logging into Plushion.
4. Plushion and Content
All data adopted or presented on Plushion, including but not limited to text, data, images, articles, photographs, videos, audio, illustrations, and other materials and information (collectively referred to as "Content"), is protected by copyright and/or intellectual property rights. All Content on Plushion is provided solely for your personal, non-commercial use and must be used in accordance with these Terms of Use.
When Plushion authorizes you to access Plushion and/or Content, such authorization is non-exclusive, non-transferable, and limited to use in accordance with these Terms of Use. Plushion has the absolute and sole discretion to modify, remove, or change the presentation, nature, or functionality of part or all of the Content on Plushion at any time without prior notice.
You must comply with all copyright notices, trademark rules, and related information permissions contained in Plushion and the Content accessed through it. Without the prior written express consent of the individual holder or licensee, you may not use, copy, reproduce, modify, translate, publish, distribute, transmit, broadcast, perform, upload, display, license, sell, adapt, provide copies, or otherwise exploit Plushion, its Content, third-party submitted data, or other proprietary rights not owned by you in any manner that violates or infringes third-party rights, for any reason or purpose.
5. Intellectual Property Rights
All intellectual property rights related to Plushion belong to Plushion or have been licensed to it for use on the platform. Pursuant to applicable copyright laws, international conventions, and other relevant intellectual property laws, Plushion, Services, and Content constitute collective works and/or compilations protected by copyright and other intellectual property laws. You agree:
(a) Not to modify, publish, transmit, participate in the transfer or sale, reproduce, create derivative works, distribute, perform, display, or otherwise exploit any Content, software, data, or Services of Plushion in whole or in part.
(b) To download or copy Content (and items presented on Plushion or related to the Services) only for personal, non-commercial use, ensuring compliance with all copyright and other terms notices contained therein.
(c) Not to store a substantial portion of any Content in any form, except for personal, non-commercial use, and expressly prohibit copying, providing copies, or storing any Content without the prior written permission or license from Plushion or the copyright holder specified in the copyright notice.
6. User-Submitted Data
Information you provide when accessing Plushion or using the Services may be utilized by Plushion and/or other Operators related to the Services, and such information may be visible to other users of Plushion. When you post information or Content on Plushion or otherwise provide Content, data, or information (collectively referred to as "User-Submitted Data") to Plushion and/or other Operators related to the Services, you indicate:
(a) You authorize Plushion and other Operators to use part or all of such User-Submitted Data (including all related intellectual property rights) in providing the Services and operating Plushion and its business, including but not limited to promoting and redistributing part or all of the Services (and derivative works) in any media form and through any media channels, with such authorization being non-exclusive, worldwide, royalty-free, perpetual, irrevocable, sublicensable, and transferable;
(b) You agree and authorize Plushion to use your personal data in accordance with the Privacy Protection Policy in effect from time to time;
(c) You authorize each user of Plushion, within the scope permitted by these Terms of Use, to access your User-Submitted Data via the platform’s features and to use, modify, reproduce, distribute, create derivative works, display, and perform such User-Submitted Data, with such authorization being non-exclusive;
(d) You confirm and agree that Plushion has the right to rearrange, modify, create derivative works, excerpt, and translate your User-Submitted Data. For clarity, unless otherwise agreed in writing, the rights granted to Plushion do not affect your ownership of the User-Submitted Data or your right to authorize others to use it; and
(e) You represent and warrant that your User-Submitted Content (including but not limited to text, images, and photos) does not violate or harm any current laws, regulations, or third-party rights; and
(f) You are solely responsible for all User-Submitted Data posted publicly on or privately transmitted through Plushion, and Plushion bears no responsibility for any errors or omissions in such content.
7. User Representations, Warranties, and Covenants
You represent, warrant, and covenant to Plushion that you will not provide any user data to third parties or use Plushion or Services in the following manners:
(a) Infringing or violating any third party’s intellectual property rights, proprietary rights, publicity rights, privacy rights, or other rights;
(b) Violating any laws or regulations;
(c) In a harmful, fraudulent, false, threatening, abusive, harassing, defamatory, obscene, vulgar, or otherwise objectionable manner;
(d) Engaging in commercial activities and/or sales, such as contests, gambling, bartering, advertising, or pyramid schemes, without the prior written consent of Plushion;
(e) Defaming or impersonating any person or legal entity, including but not limited to any employee or representative of Plushion; or
(f) Containing viruses, Trojan horses, worms, time bombs, or other harmful computer codes, files, or programs.
Plushion reserves the right to remove any User-Submitted Data from the platform at any time, with or without reason (including but not limited to claims or allegations from third parties or authorities regarding such data, or suspicion of your breach of prior representations, warranties, or covenants), without prior notice.
You are solely responsible for retaining, recording, and reporting any taxes, liabilities, or government-imposed fees related to activities provided through Plushion and/or Services.
8. Registered Account and Security
During the use of the Services, you may be required to create and maintain a Plushion account (hereinafter referred to as a "Plushion Account").
As part of the terms for certain Services, you may be required to register and set a password and username (Plushion User ID) on Plushion. If you log in via a third-party website or service, Plushion may require your Plushion User ID to match your username on that third-party website or service.
You must provide accurate, complete, and up-to-date user information to Plushion. Failure to do so will be deemed a breach of these Terms of Use, potentially resulting in the immediate termination of your right to use the Plushion Account.
You represent that you shall not: (a) select or use another person’s Plushion User ID to impersonate them; or (b) use a Plushion User ID not authorized by another person without permission.
Plushion reserves the absolute discretion to refuse registration or cancel a Plushion Account. You are responsible for maintaining the confidentiality of your password and for any loss and/or damage resulting from unauthorized access to your Plushion Account.
9. Ordering
9.1 Unless otherwise stated, we are not the seller or supplier of the goods. We manage the website, arrange the order processing, and, where applicable, facilitate the delivery of goods you order from suppliers through our website.
9.2 When you place an order, you are indicating your intent to purchase the goods from the supplier at the specified price. Once submitted, you may not cancel the order, even if we have not yet accepted or rejected it.
9.3 We will confirm receipt of your order via email. This confirmation email will provide:
9.3.1 Details of your order,
9.3.2 Pricing details,
9.3.3 Order tracking information, and
9.3.4 Estimated shipping and delivery details.
This communication will signify our acceptance of your order on behalf of the supplier. You may track your order status online.
9.4 Inventory availability is displayed online and updated periodically by suppliers but should not be relied upon as an exact statement of stock for goods you intend to purchase.
9.5 We reserve the right to refuse or cancel an order at our sole discretion for any reason, including but not limited to:
9.5.1 Insufficient stock of the ordered goods;
9.5.2 Inability to arrange delivery to your region; or
9.5.3 Errors in the price of one or more ordered items due to human or computer errors or incorrect pricing data from the supplier.
9.6 If we cancel your order, we will notify you via email and refund any amount deducted from your credit card as soon as possible, but no later than thirty (30) days from the order date. You accept that we are not obligated to compensate you for any dissatisfaction.
9.7 Additional Charges
Plushion reserves the right to request payment or charge you for any Services provided. You shall pay all applicable fees for the Services you select in accordance with Plushion’s instructions. Plushion may deduct any unpaid fees owed by you from any refund permitted under these Terms of Use, if applicable.
9.8 Fee Changes
Plushion reserves the right to change prices and fees at any time, with changes communicated via email or posted on Plushion. Continued use of the Services after such changes are notified signifies your agreement to and acceptance of the revised prices and fees.
9.9 Rights and Obligations of Plushion
Plushion reserves the absolute discretion to refuse or cancel any service order or purchase that may violate these Terms or Hong Kong laws.
Plushion strives to provide or negotiate with suppliers for the best market value for Services. You acknowledge and agree that any taxes or additional fees arising from the use of individual Services are expressly excluded from the best price calculation.
While suppliers are required to provide accurate and up-to-date pricing for Services on Plushion, we cannot guarantee the accuracy of the Services at all times.
The above terms and conditions and refund policy apply to all Plushion users globally to the maximum extent permitted by applicable laws in the relevant jurisdiction.
10. Promotions
10.1 Plushion Promotion Codes
Plushion promotion codes are single-use codes provided through marketing campaigns or sent via email, which can be used as a discount for future bookings on Plushion. It is clarified that if a promotion code has been used during a booking on Plushion, it cannot be refunded or reimbursed, even if the user requests a refund or under any other circumstances.
Plushion promotion codes may be obtained as follows:
(a) You may receive a Plushion promotion code through an invitation program; or
(b) You may be granted a Plushion promotion code at the sole discretion of Plushion for various reasons.
10.2 Abuse of Discounts and These Promotion Terms
If, under any circumstances, Plushion discovers that a Plushion promotion code has been obtained fraudulently, in a manner not permitted by Plushion, or in violation of these Terms of Use, Plushion reserves the right to:
(a) Immediately terminate your Plushion Account;
(b) Cancel all previously obtained promotion codes;
(c) Refuse to provide you with Services; or
(d) Exercise sole absolute discretion to address the matter in any reasonable manner, including but not limited to pursuing civil or criminal action to recover related losses.
In the event of any dispute arising from the enforcement of these promotion terms, the Company reserves the final right of interpretation and decision.
11. Invitation Promotion Program
Plushion may offer members the opportunity to earn discounts or promotions on certain websites when they invite friends to become members of the Plushion website, provided such friends submit membership applications through authorized invitation channels (e.g., via Plushion, Facebook, or other social media channels supported by Plushion), thereby earning an invitation promotion.
You may only obtain invitation promotions through Plushion’s authorized member invitation mechanism; invitations made outside authorized channels will not generate any invitation promotions. You understand that invitation promotions are non-transferable, non-auctionable, non-barterable, non-sellable, and cannot be shared with other members.
You will only receive an invitation promotion when a friend, invited by you, completes their first valid booking on the Plushion website through an authorized channel. If your friend fails to follow the instructions in the invitation email or other valid invitation mechanism to accept the invitation, you will not receive the invitation promotion, and Plushion bears no responsibility to you for your friend’s non-compliance.
You agree that holding multiple Plushion Accounts violates these Terms of Use, and sending invitation letters to other email addresses or accounts, or otherwise attempting to circumvent Plushion’s invitation promotion system, may result in the loss of your membership and all invitation promotions in your account, without affecting Plushion’s other rights or remedies.
You shall not independently promote our invitation promotion program. You shall not represent Plushion in any promotional, marketing, or advertising activities, including using any trademarks of Plushion.
If Plushion suspects that an invitee or invitation promotion has been obtained fraudulently, in violation of these Terms of Use, or in any other manner not consented to by Plushion, it reserves the right to cancel the invitee and invitation promotion earned by the member.
Plushion will send the invitation promotion to your account within approximately 24 hours after an eligible invitee successfully books an activity for the first time through Plushion.
Based on each user’s behavior, Plushion reserves the right to modify the content of the Plushion Invite a Friend program.
The invitation promotion program is valid unless prohibited by law. Plushion reserves the right to revise or terminate the invitation promotion program at any time. If accumulating and/or using invitation promotions incurs any tax liability, participants must fulfill such obligations themselves. You understand that your account may not accurately reflect the invitation promotions you have earned, and Plushion bears no responsibility for any errors in your account.
12. Privacy Policy
For the policy regarding Plushion’s use of your personal data, please read the Company’s current Privacy Policy, which is incorporated into these Terms of Use. By accepting these Terms of Use, you agree to the Privacy Policy and agree to be bound by it.
13. Indemnification
You shall indemnify and hold harmless Plushion, its parent company, subsidiaries, affiliates, officers, directors, and employees from any claims or demands made by any third party arising from your or any third party’s use of your Plushion user identity to access Plushion, use Plushion, breach of these Terms of Use, infringement of intellectual property rights, or violation of the rights of any person or entity (including but not limited to all losses, liabilities, settlements, costs, and attorney fees), and provide compensation if any damage occurs.
The Company may participate in the defense of any claim or legal action and any settlement negotiations. You shall not enter into any settlement that may adversely affect the Company’s rights or obligations without the Company’s prior written consent. The Company reserves the right to fund and independently defend and control any claim or legal action at its own expense.
14. Disclaimer and Limitation of Liability
Regarding access to and use of Plushion, Services, and Content, Plushion has no special relationship with you and owes you no fiduciary duty. You acknowledge that Plushion does not control and is not responsible for taking any action regarding:
(a) Which users may access Plushion;
(b) The Content you access through Plushion;
(c) The impact of Content on you;
(d) How you interpret or use the Content;
(e) Actions you may take due to exposure to the Content.
You acknowledge and agree that Plushion Services may be provided by other Operators or third parties, and that suggestions or recommendations included may be provided by other Operators or users of Plushion. Plushion makes no representations or warranties regarding the accuracy of service descriptions or the suitability of suggestions or recommendations for Services provided or purchased through Plushion.
Plushion, its parent company, subsidiaries, affiliates, officers, directors, and/or employees shall not be liable under any circumstances for any loss of profit or any indirect, consequential, special, incidental, or punitive damages arising from:
(a) Plushion;
(b) These Terms of Use;
(c) Your or a third party’s breach of these Terms of Use;
(d) Any actual or intended communication or transaction between users, even if we have been notified of the possibility of such damages.
The foregoing limitations and exclusions apply regardless of the cause of the damage, including:
(a) Breach of contract;
(b) Breach of warranty;
(c) Strict liability;
(d) Tort;
(e) Negligence; or
(f) Any other cause of legal action, to the maximum extent permitted by applicable law.
Suppliers are responsible for maintaining sufficient inventory of products and/or services published and/or sold on Plushion and ensuring the accuracy of related product and/or service descriptions. Plushion cannot verify all information provided by suppliers.
Plushion is not liable for any supplier’s actions, errors, omissions, representations, warranties, breaches, product liability, negligence, or resulting personal injury, death, property loss, or other damage or costs. Plushion is not responsible for any costs, expenses, claims, or damages arising from any Service or product, nor for any costs or expenses to remedy the same. Without prejudice to the foregoing, Plushion assumes no liability and will not issue refunds for delays, cancellations, force majeure, overbooking, strikes, or other causes beyond its direct control, nor for additional costs, omissions, delays, substitutions, rerouting, or actions by any government or authority.
If goods or services ordered through Plushion are damaged or defective, Plushion bears no responsibility to you. The respective supplier of that specific Service or product shall bear full responsibility and obligations.
Suppliers shall indemnify and hold Plushion harmless from all claims and losses arising from any loss, damage, liability, injury caused to users and third parties by any Service or product they provide, or from infringement of third-party intellectual property, or from any information provided by the supplier to Plushion or resulting third-party losses. For the purposes of this Clause 15, “claims” means all demands, claims, lawsuits, penalties, fines, and liabilities (whether criminal or civil, contractual, tortious, or otherwise); “losses” means all losses, including but not limited to financial losses, damages, legal fees, and other expenses of any nature.
All Content, software, features, and information obtained through Plushion is provided "as is." To the maximum extent permitted by applicable law, the Company makes no express or implied representations or warranties, including but not limited to the Content, software, data accessed through Plushion, information, features, products, Services, or links to third parties, or regarding the transmission of sensitive information through Plushion in violation of security practices, or for non-infringement, operability, fitness for a particular purpose, or accuracy. The Company does not warrant that the functions contained in Plushion or any data or Content will be uninterrupted or error-free.
You acknowledge and agree that any content transmitted to Plushion is not confidential, and your communications may be read or intercepted by others. You further acknowledge and agree that your communications with us, and information posted on Plushion, including travel itineraries and/or activities, do not establish any confidential, fiduciary, implied contract, or other relationship with the Company beyond what is specified in these Terms of Use.
You acknowledge and agree that you will not hold the Company or attempt to make the Company liable for Content provided by other Operators or third parties, and you further acknowledge and agree that the Company is not a party to transactions related to Services provided by other Operators or third parties. The Company has no control over and makes no warranties regarding the safety of any transactions, travel itineraries, and/or activities on Plushion, or the accuracy or truthfulness of any listings or other Content provided by other Operators or third parties.
If at any time during or before using Plushion and/or Services you are dissatisfied, disagree with any part of these Terms of Use, or have other disputes or claims related to these Terms of Use or Plushion with the Company or other users, your sole remedy is to immediately cease using or completely avoid using Plushion.
Under any circumstances and to the maximum extent permitted by applicable law, the liability of the Company or any member of Plushion to you or any third party for matters arising from Plushion shall be limited to the greater of: (a) the amount you paid to us in the twelve (12) months immediately preceding the legal action causing the liability; or (b) a cumulative maximum of HKD 500.00 for all claims.
15. Interactions with Third Parties
Plushion may contain links to third-party websites or services (hereinafter "Third-Party Websites") not owned or controlled by Plushion. The presence of links to Third-Party Websites on Plushion does not imply endorsement or recommendation by the Company of such Third-Party Websites or the information, products, advertisements, or other materials available thereon.
You assume all risks when accessing Third-Party Websites. You represent and warrant that you have read all applicable policies of any Third-Party Websites related to your use of the Services and agree to be bound by such policies, in addition to your obligations under these Terms of Use, and will comply with all applicable policies of Third-Party Websites.
Plushion has no control over and bears no responsibility for the content, accuracy, privacy policies, or practices of Third-Party Websites, or the opinions expressed thereon. Furthermore, Plushion does not, and cannot, monitor, verify, review, or edit the content of Third-Party Websites. By using the Services of Plushion, you agree to release Plushion from any and all liability arising from your use of any Third-Party Website.
If you interact with any organization and/or individual (including but not limited to other Operators) through Plushion’s Services, including payment and delivery of goods or services and any other terms, conditions, warranties, or representations related to such transactions, this is a relationship between you and such organization and/or individual, and the Company is not involved.
You should conduct any investigation you deem necessary or appropriate before engaging in any online or offline transactions with such third parties.
You agree that Plushion is not liable for any loss or damage resulting from such transactions. If a dispute arises between participants on the website or between users and any third party, you understand and agree that Plushion has no obligation to be involved. In the event of a dispute with one or more other users or third parties, you hereby release Plushion, its parent company, subsidiaries, officers, directors, employees, agents, and successors from any claims, demands, and damages (actual and consequential), known or unknown, suspected or unsuspected, disclosed or undisclosed, arising from or related to such disputes.
16. Termination
These Terms of Use remain in full effect as long as you use Plushion or Services. Plushion may terminate or suspend your right to access the Services or your membership at any time, for any reason, without prior notice, and all information related to your membership will be lost or destroyed. Plushion will also immediately terminate or suspend any and all Services provided to you and your right to access Plushion if you breach any term or condition of these Terms of Use, without prior notice or liability.
Upon termination of your account, your right to use the Services, access Plushion, and any Content will immediately cease, but any provisions of these Terms of Use that, by their nature, should survive termination will remain in effect, including but not limited to ownership provisions, disclaimers, and liability limitations.
If these Terms of Use are terminated due to your breach, Plushion reserves the right to cancel any vouchers purchased and unused prior to termination without refunding you or bearing any liability.
17. Contracts (Rights of Third Parties) Ordinance
No person other than the parties to these Terms of Use shall have the right to enforce any term of these Terms of Use under the Contracts (Rights of Third Parties) Ordinance (Chapter 623 of the Laws of Hong Kong).
18. Governing Law
These Terms of Use shall be governed by the laws of the Hong Kong Special Administrative Region, and you agree to submit to the non-exclusive jurisdiction of the courts of the Hong Kong Special Administrative Region.
19. Miscellaneous Provisions
If any provision of these Terms of Use is deemed unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary to ensure the remainder of these Terms of Use remains fully enforceable.
You may not assign, transfer, or sublicense these Terms of Use without the prior written consent of Plushion, but Plushion may assign, transfer, or delegate these Terms of Use and its rights and obligations without your consent.
The terms and conditions of these Terms of Use are written in English, and any translations in other languages are for reference only. In the event of any discrepancy between a translated version and the English original, the English version shall prevail.
